Nugget CBD will close its doors on October 25th

In a nationally unprecedented and deeply troubling move, the Boise Police Department has quietly begun taking steps toward effectively banning all CBD consumables in Idaho.

During the week of September 21, officers visited local retailers warning them of potential felony criminal charges related to CBD products under a new interpretation of the Idaho Food, Drug, and Cosmetics Act of 1959 (Idaho Code § 37-122).  Notably, this 70-year-old statute contains no mention of hemp or CBD.

I spoke directly with Officer Kolos at the Boise Police Department to request clarification on this change. While he was unable to provide any resources beyond recommending that I review Code 37, he did say, “…if you continue to carry CBD consumables, you do so at your own risk.”

This abrupt and ambiguous shift in enforcement harms consumers and small businesses alike – driving customers into an unregulated online market flooded with adulterated, mislabeled, and fraudulent products, while cutting them off from trusted local retailers.

Because the FDA forbids businesses from making specific claims about the benefits of CBD, I won’t tell you about the many ways CBD has helped improve  lives. What I will say is this: when policy changes are made without scientific grounding, the consequences go beyond losing access to safe, local CBD. We also lose the ability to make informed choices about our own health.

  • What is CBD?

    Cannabidiol, is one of the many cannabinoids naturally produced by hemp and cannabis plants. Interestingly, your body also creates similar compounds as part of the endocannabinoid system, which helps regulate things like mood, pain, and sleep.

  • How is CBD different from THC?

    CBD and THC are both cannabinoids, but they interact with your body in different ways. THC binds to CB1 receptors in the brain, which is what causes a psychoactive “high.” CBD, on the other hand, binds to CB2 receptors, which are found throughout the body—and it won’t make you feel high, just relaxed.

  • How are Hemp and Cannabis Different?

    Hemp and cannabis come from the same plant species, but they’re classified differently based on THC content. Hemp contains 0.3% THC or less, and has been legal in the U.S. since 2018. In contrast, cannabis typically contains more THC and is regulated differently in each state.
    At Nugget CBD, all our hemp products are THC-free and fully compliant with Idaho state law.

  • Isn't some THC better than none?

    Hemp extract products typically fall into three categories:

    • Full-Spectrum: Contains all of the naturally occurring cannabinoids, terpenes, and compounds from the hemp plant—including trace THC.

    • Broad-Spectrum: Contains all the same plant compounds, but with THC removed.

    • Isolate: Contains only CBD, with all other cannabinoids removed.

    It’s a common misconception that THC is necessary to unlock the therapeutic benefits of CBD—but this claim is not supported by current research.

    While some studies explore the “Entourage Effect,” the therapeutic properties of CBD alone are well-documented—especially when products are high-quality, independently tested, and properly dosed.

    Our products contain many active cannabinoids and terpenes so you can have the benefit of the Entourage Effect without THC.

  • Is CBD Legal in Idaho?

    Yes, CBD is legal in Idaho—but there is a lot of confusion over this topic, even amongst law enforcement.

    In Idaho, CBD products are legal only if they contain absolutely zero THC—trace amounts are NOT permitted and chemicals similar to THC are illegal, too.

    At Nugget CBD, we ensure that all our products comply with Idaho’s stringent regulations by testing them at the Utah State Department of Food and Agriculture Lab.

    Pet supplements that contain CBD are legal in Idaho, but using hemp in feed for livestock is not. This has been a point of confusion for many years now.

  • Is CBD safe for pets?

    Generally, yes—CBD is considered safe for pets like dogs and cats when used appropriately. In fact, much of the early research on CBD’s effects was conducted on animals, so there’s actually more data available on pets than people in some cases.
